Complaint:Astatementthatasituationisunsatisfactoryorunacceptableorthatsomeonehasdonesomethingwrong.Inbusinessactivities,nomatterhowperfectanorganizationmaybe,Complaintsfromthecustomersarecertaintoarise.Ininternationaltrade,claimsdonothappenineverytransactionbutoftenoccur.Sometimeswhenthelossisnotserious,thepartysufferedthelossmaynotlodgeaclaimforcompensation.Insteadhewritesacomplainttocalltheotherparty’sattentiontoavoidingthismatterhappeningagain.Claimsareusuallyraisedbybuyersforgreatloss,forexample:losscausedbynon-deliveryordelayofdeliveryandimproperpacking,breachofcontract,etc.However,sellersmayalsoraiseclaimsagainstbuyerfornon-establishmentofL/Corbreachofcontract,etc.Causesforclaim(1)Thesellerisheldresponsibleforthefollowingclaims:Non-deliveryorpart-delivery(未交货或交货不足)·Delayindelivery/shipment(延误装船)·Inferiororwrongquality(品质(pǐnzhì)不良)·Wrongquantity(数量不符)·Insufficientpacking(包装不当)·Failureinenteringintocontract(成交后不签约)·Non-fulfilmentsofcontract(片面毁约)·Discrepanciesinspecification(规格不符)(2)Thebuyerisheldresponsibleforthefollowing:·RefusetoopenanL/C(拒开信用证)·DelayinopeningL/C(迟开信用证)·Delayinpayment(延迟付款)·Commissionunpaid(不付佣金)·Failureinenteringintocontract(拒不签约)·Non-fulfilmentofcontract(片面毁约(huǐyuē))(3)Thecarrierisheldresponsibleforthefollowing:·Short-landed(短卸货物)·Goodsmissing(货物丢失)·Roughhandling(野蛮装卸)·Others(其他)抱怨(bàoyuàn)、投诉Thereare2kindsofcomplaintsbeingfrequentlymadebybuyers:2.Thecomplaintusedasexcuses:Thereisthecomplaintmadebybuyerswhofindfaultwiththegoodsasanexcusetoescapefromtheircontracts,eitherbecausetheynolongerwantthegoodsorbecausetheyhavefoundthattheycangetthemcheaperelsewhere.RulesforDealingWithAComplaint3、Allcomplaintsshouldbetreatedasseriousmattersandthoroughlyinvestigated.主张(zhǔzhāng)、索赔TheReasonsforClaimsDocumentsRequiredWhenLodgingaClaimThecommonexpressionsofclaimcomplaintcomplainclaimn.索赔(suǒpéi)1)表示提出或要求索赔(suǒpéi):lodge/file/issue/enter/make/register/raiseaclaim2)表示理赔(违约的一方同意受理遭受损害一方所提出的赔偿要求):entertain/settleaclaim3)拒绝索
