票据管理实施办法中国人民银行令1997年第2号(ApprovedbytheStateCouncilonJune23,1997PromulgatedbythePeople'sBankofChinaonAugust21,1997)颁布日期：19970821实施日期：19971001颁布单位：人民银行Article1TheseMeasuresareformulatedinpursuanceoftheprovisionsofArticle2TheseMeasuresshallbeapplicableintheadministrationnegotiableinstrumentswithintheterritoryofthePeople'sRepublicofChina.Article3ThePeople'sBankofChinaisthedepartmentofadministrationofnegotiableinstruments.AdministrationofnegotiableinstrumentsshouldabidebytheprovisionsofTheLawofNegotiableInstrumentsandtheseMeasuresaswellasrelevantlawsandregulationsandmustnotharmthelegitimaterightsandinterestsofpartiestoabill.Article4Partiestoabillshouldengageinbillactivities,exercisebillrightsandfulfilbillobligationsinaccordancewithlaw.Article5PartiestoabillshouldusebillsonuniformformatprescribedbythePeople'sBankofChina.Article6ThemakersofbillsofbankexchangeshallbebankshandlingthebusinessofbillsofbankexchangeapprovedbythePeople'sBankofChina.Article7Themakersofbankers'ordersshallbebankshandlingthebusinessofbankers'ordersapprovedbythePeople'sBankofChina.Article8Themakersofcommercialbillsofexchangeshallbeenterprisesandotherorganizationsotherthanthebanks.Themakersofcommercialbillsofexchangeapplyingtobanksforthehandlingofacceptanceofbillsofexchangemustmeetthefollowingqualifications:(1)openingofdepositaccountinbanksofacceptance;(2)enjoyinggoodcredibilityandhavingreliablesourceofcapitalforthepaymentoftheamountofthebillsofexchange.Article9Acceptingbanksofcommercialbillsofexchangemusthavethefollowingqualifications:(1)havingtruerelationsofauthoritytopaywiththemakers;(2)havingreliablecapitalforthepaymentoftheamountofthebillsofexchange.Article10Thebearersofcommercialbillsofexchangeapplyingtobanksfordiscountoncheckmusthavethefollowingqualifications:(1)openingofdepositaccountinbanks;(2)havingtruetradingrelationsandcreditor-debtorrelationswiththemakersandpriorendorsers.Article11Themakersofchecksshallbeenterprises,otherorganizationsandindividualswithopeningofcheckdepos
