论实用艺术品的工业版权保护制度摘要实用艺术品是一种具有实用功能的艺术作品，属知识产权法保护范畴。实用艺术品在国民经济发展中的地位越来越重要，因此，对实用艺术品的法律保护就显得日益重要。本文旨在对于国内外实用艺术品立法保护的情况进行研究，分析在新时期我国应实行的实用艺术品法律保护方法。由于实用艺术品兼具“艺术性”和“实用性”，因而对其采用外观设计法保护还是著作权法保护一直是各国法学界争论的焦点。文中对中外实用艺术品法律保护制度进行了研究，就实用艺术品的法律保护趋势、世界各国及我国实用艺术品法律保护的立法情况进行了分析比较。我国对实用艺术品主要归入著作权法中的美术作品中加以保护，申请了外观设计的只要满足著作权法中美术作品的条件，也将予以保护。可见，我国采取了综合的保护方式，即国际公约、著作权法与专利法均对实用艺术品符合条件的部分加以保护。这种方式在立法初期产生了积极的推进作用，看似万无一失，但在各方面还存在着许多不足，函待研究与解决。本文建议对实用艺术品采用工业版权的法律保护方式，修改现行著作权法，把实用艺术品置于专利法与版权的双重保护之下，或许是一种更为合理的做法。[关键词]工业版权实用艺术品保护ResearchonWorksofAppliedArtProtectionbyIndustrialCopyrightAbstractWorksofappliedart,whichisisakindoffunctionalworkofart.Itiswithinthescopeofintellectualpropertyrightsprotection.Whiletheworksofappliedartindustryisplayingamoreandmoreimportantroleinthestateeconomy,worksofappliedartprotectionisbecomingincreasinglyimportant.Thisarticleattemptstodosomeresearchesintoperfominginternationalobligation,reinforcingthelegalprotectionofworksofappliedart.ItrytoanalyzeapraticallegalprotectivepatternofworksofappliedartinChinainthenewera.Theworksofappliedartpossessesboth“Artistic”and“Practical”quality.Therefore,ithasbeenacontroversiallegalissueofdifferentcountriesthatwhichtypeoflawsisapplicable,CopyrightLaworPatentLaw.Inthisessay,ItrytodosomeresearchesandanalysisintoChineseandforeignworksofappliedartlegalprotectionsystemandmakeacomparisononworksofappliedartdevelopmentandlegalprotectiontrend,andlegislativesystemforworksofappliedartlegalprotectionsystem.TheworksofappliedartismainlyprotectedbyCopyrightLawasworksofart,theworkswhichappliedPatentofDesignwillalsobeprotectedbyCopyrightLawaslongasitcanbeproectedasworksofartinChina.ThepresentlawonworksofappliedartprotectioninChinaisacomprehensivemethodthatcombinesInternationalConvention,CopyrightLawandPatentLaw.Thisprotectivepatternfunctionseffectivelyatthefirststageofworksofappliedartlegislation,seemstobeperfect,butnowitsdisadvantageskeepemergingandtheyneedtoberesearchedandsolvedout.Thisarticlesuggestsacomprehensiv
