华中科技大学硕士学位论文我国传统知识保护法律制度研究姓名：谢英姿申请学位级别：硕士专业：经济法指导教师：蓝寿荣20060401华中科技大学硕士学位论文摘要传统知识正逐渐被认为是一种具有巨大经济潜力的知识来源。但由于西方知识产权体系将之视为处于“公共领域”的资源，相当多的传统知识被盗用和滥用，其创造者的权益遭到了危害和忽视。为改变这一不公平的情况，拥有着丰富的传统知识的发展中国家率先掀起了保护传统知识的热潮。我国是一个传统知识异常丰富的国家，传统知识的保护因此成为政府和学者所关注的一个重要问题。本文在对传统知识保护议题的提出，相关基础概念研究等情况做出回顾之余，对国外的传统知识宪法和知识产权法律保护，尤其是知识产权法律保护的途径，包括著作权，专利，实用新型，植物专利，植物品种证书，商标，地理标识，商业秘密，外观设计等方面作了详细的介绍，并且举出实例分析了这些保护途径在实践中的利弊。本文还对国外建立专门制度保护传统知识的现状做了一些介绍。其中，菲律宾的集体知识产权保护法案和印度的传统知识专门保护机制是本文相对详细的介绍和分析的对象。国外的有益经验值得我国借鉴。在本文最后也是最重要的部分，笔者对我国的传统知识法律制度的现状做了详细回顾和评析，并对我国今后的立法目的和思路提出了保护范围要全面，精神权益和经济权益保护相结合，充分发挥知识产权法在保护传统知识上的作用，以及建立特别机制保护传统知识的四个具体建议，以期对今后我国传统知识保护法律制度的完善带来些许裨益。关键词:传统知识保护法律制度II华中科技大学硕士学位论文AbstractTraditionalknowledgeisgraduallyrecognizedasanimportantknowledgesourcethathasgreateconomicpotentialities.However,inwesternintellectualpropertysystem,traditionalknowledgeisconsideredtobeknowledgeinthepublicdomain,andisrarelysurvivedfromthefateofmisappropriation.Issuessurroundingtheprotectionoftraditionalknowledgeandbenefitssharingaremoreandmoreconsideredtobemattersthatneedtobesolvedinstantly.Chinaisabundantintraditionalknowledge,andiscertainlyconcernedfortheprotectionoftraditionalknowledge.Inthefirstchaptertheessaygivesretrospecttothebasisresearchontraditionalknowledge,e.g.theconcept,thecharacteristicsoftraditionalknowledge.Thesecondchapteroftheessayanalyzesthepracticesofothercountriesontraditionalknowledgeprotection.Inthoselegalpracticesontraditionalknowledgeprotection,theprotectionthroughintellectualpropertysystemismostconcerned.Copyrights,patents,pettypatentmodels,plantpatents,plantvarietycertificates,tradesecrets,geographicalindicators,trademarks,industrialdesignareallintroducedtobeeffectivemeanstoprotecttraditionalknowledge.SuiGenerisprotectionsystemsisalsointroducedinChapterTwo,anddoingsinthePhilippinesandIndiaareespeciallymentionedwithdetailedintroduction.Theirhelpfulexperiencesareworthytouseforreferenceforus.Inthelastandmostimportantchapt
