课题申报论文：课题申报同行评议制度行政回避制度救济制度【中文摘要】经济全球化时代,科技竞争力是一国提升竞争实力的主要力量,因此各国都加大了对科技和教育的投入。我国每年对教育和科研经费的投入逐渐增加以及在科技方面的政策支持强度也不断加强。如何有效利用巨额资金和正确发挥政策的作用,是当前一个比较重要的课题。尽管课题申报已经摆脱了无法可依的状况,但是当前课题申报中还存在着很多不足,如课题申报制度中各主体之间信息不对称、同行评议的非公正性、权利救济等问题。因此,对课题申报行为的行政法规制势在必行。本文首先对课题申报行为予以定性,主要从课题申报行为与行政许可、行政确认进行比较这两个方面对课题申报行为的性质进行论证,最后得出课题申报行为为行政许可的结论。然后在此基础上,对课题申报行为的价值予以分析。价值的分析主要从过程价值和结果价值两个方面对课题申报行为价值予以分析。接着阐述当前课题申报的相关程序:申请→依托单位审核→初审→同行专家评议→专家组评审→决定。同时对当前课题申报程序中的问题予以分析。最后,在前文论证的基础之上,从法律和制度的角度对课题申报行为予以完善。主要从六个方面予以完善:课题申报程序违法的认定及后果、加强课题申报程序立法、行政回避制度、说明理由制度、同行评议制度的完善以及权利救济制度的完善。【英文摘要】Stepingintothetwenty-firstcentury,withtheglobalizationofeconomicglobalizationandtherapiddevelopmentofinformation,Chinahasbecomeevenmoreemphasisonscienceandtechnology,theruleoflawhasreachedanewheight.Nationalannualinvestmentineducationandincreasingresearchfunding,atthesametime,policysupportinsciencealsobeenstrengthened.Howeffectiveuseofhugeamountsofmoneyandtherighttoplayapolicyrole,iscurrentlyamoreimportantissue.DespitegrantapplicationhasbeenoutthesituationofCannotcandependent,atpresentgrantapplicationalsoexistsmanyproblems.Forexample,inthegrantapplication,theinformationasymmetrybetweensubjects;Non-justiceofpeerreview;Rightofreliefandsoon.Therefor,wemustregulatethebehaveofsubjectsreport.Thisarticlehasthreeparts:ThefirstpartIanalysisthebehaveofsubjectsreport’snature.ThisparthastworespectsthatarecomparingAdministrativelicenseandthebehaveofsubjectsreport,Administrativeconformationandthebehaveofsubjectsreport.Finally,IconcludethatthebehaveofsubjectsreportisAdministrativelicense.ThesecondpartIdescribethebehaveofsubject’sprogram:Application→Examinationofsupporting→Trial→Peerreviewed→Reviewpanal→Decision.ThenIanalysistheproblems.ThethirdpartIwillsolvetheproblemofthebehaveofsubjectsreportfromtheperspectiveoflegalandinstitutional.ThispartIdividesixrespeces:Identificationofsubjectsreportingprocessandconsequencesofillegal;Streng
