DecreeNo.344oftheStateCouncilofthePeople’sRepublicofChinaRegulationsontheControloverSafetyofDangerousChemicalshavebeenadoptedbythe52ndExecutiveMeetingoftheStateCouncilon9thJanuary2002.WeherebyissuetheseRegulations,whichshalltakeeffectasof15thMarch2002.Premier:ZhuRongji----------------------------------------------------------------------------------------------------------------------------RegulationsontheControloverSafetyofDangerousChemicalsDecreeNo.344oftheStateCouncilofthePeople’sRepublicofChinaPromulgationDate:26thJanuary2002EffectiveDate:March2002Promulgatedby:TheStateCouncilChapterIGeneralPrinciplesArticle1Inordertostrengthenthecontroloversafetyofdangerouschemicals,toguaranteethepeople’slifeandpropertysafety,andtoprotecttheenvironment,theseRegulationsareherebyenacted.Article2Production,operation,storage,transportation,anduseofdangerouschemicalsanddisposalofthewasteddangerouschemicalswithintheterritoryofthePeople’sRepublicofChinashallbegovernedbytheseRegulations,lawsandotheradministrativeregulationsoftheStateonproductionsafety.Article3“Dangerouschemicals”asreferredtohereinincludeexplosives,pressuregas,liquefiedgas,inflammableliquid,inflammablesolid,spontaneouscombustiblearticles,combustiblematerialsincaseofmoisture,oxidants,organicperoxide,toxicarticles,corrosives,etc.DangerouschemicalslistedontotheListofDangerousArticles(GB12268)promulgatedasthenationalstandard,thecatalogueofhyper-toxicchemicals,andotherdangerouschemicalsnotlistedontotheListofDangerousArticlesshallbedeterminedandannouncedbytheadministrativedepartmentinchargeofcomprehensivemanagementofeconomyandtradejointlywiththeadministrativedepartmentsinchargeofpublicsecurity,environmentalprotection,health,qualitycontrol,trafficcontrol,etcoftheStateCouncil.Article4Thepersonnelchieflyinchargeofunitsthatmanufacture,dealin,store,transport,andusethedangerouschemicalsanddisposeofthewasteddangerouschemicals(hereinafterreferredtoasthe“unitsofdangerouschemicals”)mustgu
