上海市职工代表大会条例（英文版）RegulationsoftheShanghaiMunicipalityontheWorkersCongress(Adoptedatthe23rdSessionoftheStandingCommitteeofthe13thShanghaiMunicipalPeople’sCongressonDecember23,2010)ChapterIGeneralProvisionsArticle1Inordertoprotectthedemocraticrightsofworkersandstaffmembers,tobuildharmoniousandstablelaborrelationshipandtopromotethecommondevelopmentofworkersandstaffmembers,enterprises,publicinstitutionsandprivately-runnon-enterpriseunitsandotherorganizations,thepresentRegulationsareformulatedinaccordancewiththeConstitutionofthePeople’sRepublicofChina,theLaborLawofthePeople’sRepublicofChina,theTradeUnionLawofthePeople’sRepublicofChina,theCompanyLawofthePeople’sRepublicofChina,theLaborContractLawofthePeople’sRepublicofChinaandotherrelevantlawsandadministrativeregulationsandinthelightoftheactualsituationinthisMunicipality.Article2ThepresentRegulationsshallapplytoallenterprises,publicinstitutionsandprivately-runnon-enterpriseunitsandotherorganizations(hereinafterreferredtoas“enterprisesandpublicinstitutions”),whichestablishandimplementtheWorkersCongressSystemintheadministrativeareaofthisMunicipality.Article3EnterprisesandpublicinstitutionsshallestablishtheWorkersCongressSystem.TheWorkersCongressshouldbeheldinenterprisesandpublicinstitutionswith100andmoreworkersandstaffmembers;usuallygeneralmeetingofworkersandstaffmembersshouldbeheldinenterprisesandpublicinstitutionswhereworkersandstaffmembersarelessthan100.TheWorkersCongress(orgeneralmeetingofworkersandstaffmembers,thesamebelow)isthebasicdemocraticmanagementformofenterprisesandpublicinstitutions,animportantsystemforcoordinatingthelaborrelationandasetupforworkersandstaffmemberstoexercisetheirdemocraticmanagementrights.TheWorkersCongressshouldfullypromotedemocracyandimplementthemajorityrule.Article4EnterprisesandpublicinstitutionsshallguaranteethattheWorkersCongressexercisesitsfunctionsandpowersinaccordancewithlaws,andensurethattheworkersandstaffmembershavetheirstatutoryrightstostayinformed,participate,expresstheirvi
