我国西部农村土地问题的法学思考摘要实施西部大开发战略，加快西部发展，逐步缩小各地区之间的发展差距，实现区域经济协调发展，最终达到各地区经济普遍繁荣和全体人民共同富裕，既是社会主义本质特征要求，亦是国民经济持续协调发展的内在需要。近年来，虽然西部大开发已经取得了举世瞩目的成就，但是其中暴露了不少的问题。尤其是土地问题。本文就是针对这种情况，对西部农村土地问题进行了研究。首先通过实地调查和参看有关资料，发现西部农村中普遍存在着耕地破坏与土地撂荒的情况严重、农村土地流转不合理、非法占地批地现象严重、征地程序不合理等问题；然后通过对西部农村土地普遍性的问题进行研究，着重从农村村民文化素质不高，法律意识淡薄、农村土地流转制度不完善、法律不完善让土地违法行为有机可乘、经济利益驱动令土地违法行为肆意滋生、征地程序的不规范这几个方面分析了造成西部农村土地问题现状的原因；最后针对分析所得出的原因，提出相应的对策，指出要使西部农村土地问题得到有效的解决，就需要完善农村土地流转法律制度，完善征地法律制度、加强法治宣传，提高农民的法律意识、相关责任主体执法必严、违法必究，最终使土地问题得到有效的解决。关键字：西部农村，土地问题，土地流转，征地制度ABSTTACTImplementingthewesterndevelopmentstrategy,acceleratethedevelopmentofwestofchina,graduallynarrowthedevelopmentgapbetweenregions,toachievecoordinateddevelopmentofregionaleconomy,eventuallyreachtheregion'seconomicprosperityandcommonprosperityofallthepeople,thesearebothessentialcharacteristicofsocialismrequestandthecoordinateddevelopmentofnationaleconomycontinuedinternalneed.Inrecentyearsdevelopingthewesternregionhasmaderemarkableachievements,butwhichexposedanumberofissues,inparticularthequestionofland.Inthispaper,thesituationinthewesternrurallandissueshavebeenstudied.Firstthroughfieldinvestigationsandreadingtherelevantinformation,thefollowingissuesprevalentintheruralwesthavebeenfound:destructionofcultivatedlandandlandtrimmercominginseriouscondition,rurallandtransfersunreasonable,illegaloccupationandapprovaloflandareserious,thelandrequisitionprocedureunreasonable.Thenthroughstudyingtheuniversalissueofwesternruralland,especiallyfocusingonruralvillager’sculturalqualityisnothighandlackoflegalawareness,rurallandtransfersystemflawing,imperfectlandlawgivingopportunitytolandoffence,economicinterestsdriveinglandoffencerecklesslybreeding,thelandrequisitionprocedurewasnotbeingstandardized,weanalysisthereasonsforthestatusquoofthewestrurallandissue.Finally,correspondingcountermeasureshasbeenproposedbasedontheoutcomereasonsafteranalysising.Toletthewestrurallandissueshavebeenaneffectivesolution,weneedtoimprovetherurallandtransfersystemandthelandrequisition
