山东科技大学本科毕业论文PAGE\*MERGEFORMAT2摘要夫妻间的财产关系是婚姻关系的一项重要内容,夫妻财产制度承担着家庭的抚养、扶养、赡养等职责，对于维护家庭的和谐，社会的稳定，人类的繁衍和发展有着重大的意义。随着社会经济的发展,仅依靠法定财产制度和约定财产制度已不足以调整夫妻在财产方面的权利、义务关系。基于夫妻财产关系是婚姻关系的重要组成部分，设计一种合乎人们的实际需要又能体现人们自由民主意志的夫妻财产制度是必不可少的。完全约定化夫妻财产制度是建立在法定夫妻财产制度和约定夫妻财产制度基础之上的一种夫妻财产契约化的制度，是一种比较自由化和人性化的制度，是人类文明发展的必然要求。我国现行夫妻财产制度的规定过于笼统，在立法上不够完善，在现实生活中的可操作性比较差，不能完全保护夫妻双方的合法权益，不利于家庭的和谐和社会的稳定。建立完全约定化的夫妻财产制度，必须从立法上进行完善，司法程序上进行登记制度，对夫妻约定后的财产效力进行明确地约定，同时对亲属和继承的一些制度进行改革，以适应完全约定化夫妻财产制度，最后司法机关应该进行贯彻落实，使这一制度真正落到实处。关键词：完全约定化夫妻财产制度建立建议ABSTRACTPropertyrelationsbetweenhusbandandwifeisanimportantpartofmarriage,matrimonialpropertysystemtobearthefamily'ssupport,maintenance,maintenanceandotherduties,andmaintainingfamilyharmony,socialstability,humanreproductionanddevelopmentofgreatsignificance.Withthesocialandeconomicdevelopment,relyingonthelegalpropertysystemandpropertysystemhasnotagreedtoadjusttherightsofspousesinthepropertyandobligations.Maritalpropertyrelationsbasedonthemaritalrelationshipisanimportantpartofdesigningalinewithpeople'spracticalneedsbutalsoreflectsthedemocraticwillofthepeoplearefreematrimonialpropertyregimeisessential.Fullagreementofmatrimonialpropertysystemisbasedonthestatutorymatrimonialpropertyregimeandagreedmatrimonialpropertysystemofmaritalpropertybasedonacontract-basedsystemisakindofliberalizationandhumanizationofthesystemistheinevitablerequirementforthedevelopmentofhumancivilization.Itrejectedthetraditionalsystemofrestrictionsonmaritalpropertyagreement,amaritalpropertyagreementforalargerspace,canfullyreflecttheequalstatusofhusbandandwifeandprotectthelegitimateinterestsofbothspouses,andtogivefulllegalprotectionandrecognition.Thispaperwillmainlyfromthefullagreementofmaritalpropertysystemoverview,ChinaagreedtobuildafullsystemofmaritalpropertyinthenecessityandfeasibilityofthesystemofMatrimonialPropertyindefectanalysisandourfullagreementontheestablishmentofpointsofmatrimonialpropertyregimeproposedareastostarton.KeyWords：FullagreementMatrimonialpropertyregimeTheestab
